A NOTE ON SHARING MY ARTWORK & ARTIFICIAL INTELLIGENCE

You may share my works and images to your liking without permission so long as there is no financial or commercial motivation in any way, shape or form. If you share my art, please always ensure giving due credit in the following form: Artwork by Pauline Lendrich/Tabycoe. Please also add a link to my website if there is enough space.
At this moment, I am against the use of any part of my creations on this website or elsewhere in any way, shape or form for the training, improving and general use of Artificial Intelligence programs/software as long as AI data mining is done unethically and without compensation for me or any other participating artist.

Please refrain from using my works if it is not possible to credit them in a clearly legible, directly visible and proper way, and please do not sell or claim any of my artworks as your own.

If you would like to use my artwork for commercial or financial purposes, please get in touch with me.

Please be kindly reminded that art exists solely because artists work part- or full-time on creating it. This especially extends to the existence of AI-generated images, as these would not be possible without the creativity, time, effort, money and work put it in by human artists. By utilizing someone’s artwork without credit, permission or compensation – especially for financial gain – you are engaging in highly unethical behavior by contributing to an environment that encourages the uncompensated and unconsented use of works in the digital sphere (in other words: theft). This prevents artists from making a living from their craft without fault of their own. Allowing for artists to be fairly compensated and recognized goes hand in hand with the preservation of ever-growing creativity in this world – regardless of (maybe even especially because of)artificially generated art.

Please also note that in many countries, copyright is strictly regulated by law, and that multiple lawsuits have been brought against AI software companies. Read more about that on my blog.

ÜBER DAS TEILEN MEINER WERKE & KÜNSTLICHE INTELLIGENZ

Meine Werke und Bilder dürfen gern frei geteilt werden, solange keinerlei finanzielle oder kommerzielle Motivation zugrunde liegt. Ich bitte darum, die Inhalte stets mit einem Bildnachweis deutlich lesbar und schnell einsehbar kenntlich zu machen. (“Pauline Lendrich” oder “Tabycoe”, bei ausreichend Platz bitte auch einen Link zu meiner Website hinzufügen).

Gemäß §44b Absatz 3 UrhG widerspreche ich ausdrücklich jeglicher Verwendung meiner Werke zu Zwecken des Text- und Data-Minings, insbesondere zur Ermöglichung eines Einsatzes im Rahmen von Werken, die durch Künstliche Intelligenz (KI) geschaffen werden. Ich lehne grundsätzlich jedwede Verwendung von menschengeschaffenen Bildern und Kunstwerken im Rahmen von Data Mining für Generative K.I. (K.I. = Künstliche Intelligenz) ausdrücklich ab, solange jegliches urheberrechtlich geschütztes Eigentum ohne/gegen die Zustimmung der UrheberInnen genutzt wird, um künstlich generiertes Output gewinnorientiert und massentauglich zu erzeugen, UND solange betroffene UrheberInnen nicht an diesem Gewinn beteiligt werden.

Selbstverständlich dürfen meine Werke gegen eine Nutzungsgebühr und nach Absprache auch für kommerzielle Zwecke verwendet werden. Ich bitte in diesem Fall um Kontaktaufnahme.

Zusätzlich zum oben genannten Urheberrecht möchte ich zusätzlich darauf hinweisen, dass Künstlerinnen und Künstler im Regelfall haupt- oder nebenberuflich arbeiten, um Kunst für die Welt verfügbar zu machen. Unrechtmäßiges Teilen ohne angemessene Bildnachweise sowie die Nutzung ohne Lizenz kommt daher nicht nur unvergüteter Arbeit, sondern auch digitalem Diebstahl gleich. Es verhindert zudem, dass kreative Arbeit als gleichwertig mit anderen Berufsgruppen anerkannt wird. Fairer Verdienst für künstlerisches Schaffen geht Hand in Hand mit der Wahrung stetig wachsender Kreativität in der Welt – unabhängig von künstlich generierten Bildern.

Ich bitte um Beachtung der Tatsache, dass das Urheberrecht sowie das K.I.-betreffende Recht in der EU bzw. anderen Ländern geregelt ist oder sich im Ratifizierungsprozess befindet, und dass bereits mehrere Klagen gegen KI-Softwareunternehmen eingereicht wurden.
